Copyright Infringement

National Park College strictly prohibits all of the following illegal activities: copyright, trademark, patent, trade secret or other intellectual property infringement, including but not limited to using any copyrighted names, texts, or images; offering pirated computer programs or link to such programs, serial, or registration numbers for software programs, copyrighted music, or similar content.

NPC users should not make unauthorized copies of copyrighted materials on or using NPC’s computer systems, networks, or storage media.

NPC users should not download, upload, transmit, make available or otherwise distribute copyrighted material without authorization using NPC’s computer systems, networks, internet access, and storage media. This limitation includes using unlicensed/unauthorized peer-to-peer file services that would promote copyright infringement. NPC reserves the right to monitor its computer systems, networks, and storage media for compliance with this policy, at any time without notice, and with or without cause.

Additionally, NPC has the right to access, review, and monitor the use of its computing resources, including but not limited to equipment and usage, as well as the data that is stored or transmitted.

If a member of the faculty, staff, or student body use copyrighted materials for educational, instructional, research, scholarship or like arenas, NPC will follow the legal doctrine of fair use, currently part of the copyright law.

The unauthorized use of copyrighted material is an infringement of copyright law. Copyright infringement is a violation of law, regulation, or agreement. Unauthorized use or distribution of copyrighted material, including unauthorized peer-to-peer file sharing, may subject violators to civil and criminal liability.

Users who violate this policy are subject to disciplinary action as appropriate under the circumstances. Such disciplinary action may include termination, expulsion, and other legal actions.

Examples of copyright infringement in the academic setting:

  • Downloading and sharing digital files of music, videos, and games without permission of the copyright owner
  • Using corporate logos without permission
  • Placing an electronic copy of a standardized test on a department’s web site without permission from the copyright owner
  • Enhancing a departmental web site with music that is downloaded or artwork that is scanned without acknowledgement or permission of the copyright owner
  • Scanning a photograph that has been published and using without permission
  • Placing a number of full text articles on course web page that is not password protected and allowing the webpage to be accessible to anyone on the Internet
  • Downloading licensed software from non-authorized sites without permission of the copyright or license holder
  • Making a movie file or large segment of a movie available on the website without permission of the copyright owner

The college takes copyright infringement seriously and expects members of the faculty, the staff, and the student body to diligently mitigate infringement of intellectual property right and copyrights.
